Loyalty Scheme

The Planet Hollywood Loyalty Scheme (the “Scheme”) is sponsored and managed by Plan 17 Limited, a limited liability company registered under the Laws of Malta and has company registration number C71586 with registered address at 102, Suite 1, Triq Santa Katerina, Attard, Malta (“Plan 17”)

The Scheme is designed to reward you for doing the things you already do: dining at the world’s one and only venue inspired by the glamour of Hollywood

The following terms and conditions (the “Loyalty Scheme Terms and Conditions”) contain important information regarding the Scheme. Please read the following Loyalty Scheme Terms and Conditions carefully. Registration to the Scheme, participation in the Scheme and / or redemption of points constitutes an acceptance of the Loyalty Scheme Terms and Conditions. The Loyalty Scheme Terms and Conditions are a binding agreement between you and Plan 17 and will govern your participation in any and all Scheme offers.

Participating in the Scheme entitles members (“Members”) to take advantage of certain rewards (“Rewards”) that may change from time to time and, which may be made available for limited times, all as determined by Plan 17 in its sole discretion.

Plan 17 reserves the right to modify these Loyalty Scheme Terms and Conditions at any time, without notice to you, so it is important to check the Loyalty Scheme Terms and Conditions periodically.

Plan 17 may, in its sole and absolute discretion and without notice, cancel, change, suspend or modify any aspect of the Scheme or any Reward at any time, including the availability of any  Reward.

The Scheme Period

This Scheme will continue until terminated, suspended, modified, or converted to another rewards program by Plan 17 (the ”Scheme Period”), and shall be applicable throughout the Scheme Period except for days falling on a public holiday in Malta and / or other special occasions such as Christmas Eve, Christmas Day, New Year’s Eve, New Year’s Day, Easter Sunday, Mother’s Day and Father’s Day.

Eligibility

To become a Member of the Scheme, you must be 18 years of age or older and to enrol in the Scheme, you simply need to register on the website www.planethollywoodmalta.com  or enquire instore for registration.

Earning Points

Once you have become a Member, you can begin racking up the Planet Hollywood points (“Points”) the following ways:

• Dining at Planet Hollywood Malta: every time you dine at our venue you earn one (1) Point for every €5 (five Euro) spent (including Discretionary Gratuity), except if the Member is redeeming Points;
• Purchasing Merchandise at Planet Hollywood Malta: every time you purchase a product from merchandise store you earn one (1) Point for every €5 (five Euro) spent (excluding tax), except if the Member is redeeming Points;
• Special Events & Special Offers: Additional Points may be earned at Special Events & Special Offers as may be organised or advertised by Plan 17 from time to time;

Points earned will be credited to Planet Hollywood Loyalty card and the balance of Points will be shown on the bill once the Planet Hollywood Loyalty Card is presented to the staff of Plan 17.

Plan 17 reserves the right to cancel, suspend, terminate, revalue or modify, without notice and without liability to Members, all or part of the Points, the Points’ value structure and offers and any merchandise or service. Plan 17 reserves the right to adjudicate all Points discrepancies in its sole discretion, and the Members agree to abide by any such adjudication.

Redemption of Points

The Points are solely redeemable against purchases made at the Planet Hollywood Malta venue upon presentation of the Planet Hollywood Loyalty Card to the staff of Plan 17

Points may be redeemed in multiples of 20 and no Points may be redeemed in any other manner or quantity.

For every 20 points redeemed the Member will be given a €15 (fifteen Euro) discount on the total bill (excluding tax) of that particular purchase from the Planet Hollywood venue.

Members cannot redeem Points for more than the total amount of the purchase and Points are not redeemable for cash.

Refunds & Returns

Any merchandise received as a result of Points redemption may only be exchanged for a refund of the applicable Points redeemed for such item (not cash or credit).

Points Expiration

Points will expire upon the expiration of twelve (12) months from the date they were first earned.

If a Member does not redeem Points within this time frame, the Member forfeits all such Points.

Reward Conditions

Members may not assign or transfer any Rewards. Plan 17 makes no warranty in any respect as to any Rewards, merchandise or service available within the Scheme.

Termination

Plan 17 may, in its sole and absolute discretion, cancel, change, suspend, or modify any the Scheme or parts thereof and/or any Reward at any time, including the availability of any Reward.

Plan 17 may, in its sole and absolute discretion, terminate or suspend any Member’s participation in the Scheme for breach of these Loyalty Scheme Terms and Conditions, or for taking any actions that are inconsistent with the intent of these Loyalty Scheme Terms and Conditions. Plan 17 reserves the right at its sole discretion to prohibit any Member from participating in any aspect of the Scheme if Plan 17 deems or suspects that such Member has engaged in or has attempted to engage in any of the following:(a) acting in violation of these Loyalty Scheme Terms and Conditions; or(b) damaging, tampering with or corrupting the operation of the Scheme; or(c) acting with intent to annoy, harass or abuse any other person; or(d) any inappropriate, uncooperative, disruptive, fraudulent, potentially fraudulent, or unusual behavior or activity; or(e) activity deemed in the sole discretion of Plan 17 to be generally inconsistent with the intended operation of the Scheme. Any decision Plan 17 makes relating to termination or suspension of any Member’s participation in the Scheme shall be final and binding in all respects. Plan 17 shall be the sole determiner in cases of suspected abuse, fraud, or breach of these Loyalty Scheme Terms and Conditions or intent of these Loyalty Scheme Terms and Conditions.

Waiver and Indemnity

By participating in the Scheme, Members release Plan 17, its parent company, subsidiaries, affiliates, suppliers, advertising and promotions agencies and their respective directors, officers, employees, and agents(collectively,“Released Parties”) from any and all liability for any loss, harm, damages, cost or expense, including, without limitation, property damages, personal injury and/or death, arising out of or in any way connected to the Scheme or the use of any Rewards, whether such is a direct or indirect consequence.

Members agree to indemnify, defend and hold Plan 17 and its representatives and agents harmless from and against any and all third party claims, demands, liabilities, costs or expenses, including attorney’s fees and costs, arising from, or related to any breach by Member of any of these Loyalty Scheme Terms and Conditions or any violation by a Member of applicable law.

Without prejudice to the generality of the foregoing, in no event shall the liability, if any, of Plan 17 towards a Member and / or a third party exceed the sum of  €500 (five hundred Euro) for any event or series of events.

General Terms

Planet Hollywood Loyalty Cards are to be collected in person from the venue and the loss thereof shall be reported immediately through the web site www.planethollywoodmalta.com or in person at the venue.

In the event that an issue arises in relation to the Scheme and these Loyalty Scheme Terms and Conditions do not cater or do not clearly cater for such an event, Plan 17 shall have the absolute discretion to determine the said issue as it may deem fit.

By participating in the Scheme the Member gives his / her unconditional consent for the processing of his / her personal data in accordance with the applicable laws and regulations in relation and for the purposes of the Scheme. Furthermore, the Member agrees and accepts that Plan 17 may use his / her personal data in relation to all and any marketing campaigns launched by Plan 17.

Governing Law and Jurisdiction

The Scheme and the Loyalty Scheme Terms and Conditions shall be governed and construed in accordance with the Laws of Malta and the Courts of Justice of Malta shall have exclusive jurisdiction on any dispute arising in relation thereto.
